Terms of Use and Privacy Policy

1. About Brukas

Brukas ("the App") is a focus and productivity app developed by Sean Smith ("Developer", "I", "me"). By downloading or using Brukas, you agree to these terms.

2. License and End User License Agreement

Brukas is made available through the Apple App Store. Your use of the App is also governed by Apple's standard End User License Agreement (EULA), available at:

In any conflict between these Terms and Apple's EULA, Apple's EULA governs with respect to the App Store relationship. These Terms govern the relationship between you and the Developer directly.

3. Brukas Pro Subscription

Brukas Pro is a paid subscription available through Apple's in-app purchase system.

  • Subscriptions are billed through Apple on a monthly or annual basis, as selected at purchase.
  • Billing and cancellation are managed through your Apple ID account settings.
  • Subscription fees are charged to your Apple ID at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

Fair use.Brukas Pro is described as unlimited because there is no monthly limit on AI chat: no monthly message quota, no metering, and no cap on how many days you use it. To keep the service fast and affordable for everyone, a generous daily fair-use allowance applies, set well above what a typical focus session needs. The free tier includes 20 AI chat messages per day. These allowances exist to prevent automated abuse and runaway costs, not to limit normal use. "Unlimited" refers to the absence of a monthly cap and to a daily allowance set well above ordinary use, not to an infinite number of messages. If we change a daily allowance, we will update this page.

Your subscription is a purchase, not a tax-deductible donation. See Section 5 for information about the Developer's charitable giving.

4. Privacy

Brukas collects the following data to provide its services:

  • Account information (email address, name) when you sign in with Apple or Google
  • Focus session data (session duration, task descriptions) to power AI coaching and sync your history
  • Chat messages, stored locally and synced to the cloud when cloud sync is enabled

Brukas does not sell your data. Brukas does not show ads.

AI chat features are powered by third-party AI providers. Messages you send are processed by those providers to generate responses. Brukas does not use your messages to train AI models.

5. Charitable Giving

Annual-benefactor model. Brukas operates on a calendar-year giving cycle. Each year, the Developer selects one recipient and commits a percentage of net profits to that year's named benefactor. The 2026 recipient is Attention Deficit Disorder Association (ADDA), receiving 50% of net profits for the 2026 calendar year.

Definitions. "Net profits" means revenue received by the Developer after deducting the App Store commission (15-30%), third-party service costs (AI, hosting, sync), and other direct operating expenses. The donation is made by the Developer from the Developer's own profits. It is not collected from users and is not part of any user transaction.

Your payment. A Brukas Pro subscription is a purchase, not a charitable contribution. Users receive no tax deduction for their subscription fee. Apple processes all payments and takes a 15-30% commission before the Developer receives any revenue.

Year-to-year changes. The recipient and the percentage are set annually. Both may change from one calendar year to the next. When a new year's recipient is named, the Developer will update this page and the giving page at brukas.app/giving with the new recipient, percentage, and effective dates. The commitment shown on this page and in the App at the time of display reflects the current calendar year. This is not a binding contract with users or with ADDA.

Apple.Apple does not endorse, sponsor, or participate in this giving commitment. Apple's marks and services are referenced only to describe the App Store relationship.

6. Disclaimer of Warranties

Brukas is provided "as is" without warranties of any kind, express or implied. The Developer does not warrant that the App will be uninterrupted, error-free, or free of defects. Your use of the App is at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, the Developer's total liability to you for any claim arising from your use of Brukas is limited to the amount you paid for Brukas Pro in the 12 months preceding the claim, or $10 USD, whichever is greater.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.

9. Changes to These Terms

The Developer may update these Terms from time to time. Material changes will be noted on this page with an updated effective date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
